• After ten months of fierce, often solo dissents warning that the conservative supermajority was weaponizing the shadow docket to accelerate Trump’s mass deportation agenda, Justice Ketanji Brown Jackson appears to have forced a course correction. The Supreme Court moved the TPS cases for 350,000 Haitians and 6,000 Syrians off the shadow docket, set full oral arguments for April, and declined to strip protections in the meantime — addressing Jackson’s two core demands: protect immigrants from irreparable harm while the law is properly argued. Why It Matters for Democracy: Jackson’s willingness to call out her colleagues — publicly, repeatedly, and without pulling punches — is exactly what judicial accountability looks like from the inside. 🗣️ Chief Justice Roberts Warns That Personal Attacks on Judges Are “Dangerous” — but Won’t Name the President Doing It

• Speaking at Rice University’s Baker Institute for Public Policy in Houston, Chief Justice John Roberts made his first public comments since Trump attacked justices who ruled against his sweeping tariffs, declaring that personally directed hostility toward judges is dangerous and “has got to stop.” Roberts did not name Trump, insisted attacks come from “all over” and “not just any one political perspective,” and acknowledged that criticism of judicial opinions is a healthy part of the job. Why It Matters for Democracy: Roberts is right that threats to judges are dangerous — and utterly inadequate in his response to them. • U.S. District Judge Timothy Brooks issued a permanent injunction against Arkansas Act 573, the state law requiring the display of the Ten Commandments in every public school classroom and library, ruling it a clear violation of the First Amendment’s Establishment Clause. Seven families of different religious and nonreligious backgrounds brought the case after lower court precedent — which Act 573 directly mirrors — had already established that such mandates are unconstitutional. Gov. Sarah Huckabee Sanders announced she will appeal. (Truthout)

Why It Matters for Democracy: Judge Brooks put it plainly: children cannot avoid reading a government-mandated religious text posted in their classroom for thirteen years of compulsory schooling the way an adult can choose not to walk past a monument. This is not a close constitutional question — the Supreme Court already settled it. Arkansas passed this law anyway, daring the courts to stop it. That is what Christian nationalist legislating looks like in practice: use state power to impose religion on children, then dare judges to enforce the Constitution. Courts did their job here. The question is whether a future Supreme Court, shaped by the Federalist Society and dark money, will continue to do so — or whether it will rewrite the Establishment Clause to let states force religion into every classroom in America.

⚖️ WHY THESE STORIES MATTER

Justice Jackson stood alone for months while Roberts gave a speech that declined to name the president doing the damage, and a judge in Arkansas applied the Constitution the way it was written. These are not equivalent acts of courage, and Supreme Court accountability demands we say so. Now the Alabama Supreme Court has written that outcome into law, making it easier for officers to detain Black and Brown people who dare to say, I haven’t done anything wrong. This is what happens when state courts are filled through ideological pipelines that prioritize control over civil liberties. ⛽ Justice Alito Reverses His Own Recusal to Decide an Oil Case That Could Benefit His Investments — and His Billionaire Friend Paul Singer

• Justice Samuel Alito participated in the Supreme Court’s decision to take up a landmark climate liability case — despite having recused himself from identical cases involving the same legal question as recently as January 2025. Alito holds between $60,007 and $245,000 in individual oil, gas, and coal company stocks, and up to $100,000 in a fund where Exxon is among the top holdings. An NBC poll this month found 38% of registered voters have very little or no confidence in the Supreme Court. That number will not improve until there is a binding, enforceable ethics code with real consequences — and People Power United will not stop demanding one.

Pull back and the pattern becomes impossible to ignore. Justice Alito refuses to recuse from a case where his stock portfolio and his billionaire friend’s $2.3 billion investment are directly at stake — and there is no authority that can force him to. Pastor Michael Jennings was arrested for watering flowers while Black, confirmed innocent by the very neighbor who called police, and the Alabama Supreme Court has now enshrined the logic of that arrest into law. And 356,000 Haitian and Syrian families are waiting to learn whether a president can terminate their legal right to exist in this country with no meaningful judicial check. These are not separate crises — they are one crisis, built brick by brick over forty years by a Federalist Society pipeline designed to place ideological loyalists on every bench in America, from state courts to the Supreme Court, where they answer to no one.

The good news — and there is good news — is that courts are still pushing back. The justices declined to hand the Trump administration an immediate emergency win on TPS. Lower court judges are still issuing rulings that protect people. He falsely claimed the ruling acknowledged his “absolute right” to impose tariffs in another form — a misrepresentation fact-checkers confirm the majority opinion does not support. It was built — methodically, strategically, and with enormous amounts of dark money.

Three Trump-era confirmations completed a 6-3 conservative supermajority that has dismantled decades of precedent: overturning Roe v. Wade, weakening the Voting Rights Act, expanding presidential immunity beyond what legal scholars once thought possible.

Then came the ethics scandals. Justice Clarence Thomas accepted millions in luxury travel and real estate from megadonor Harlan Crow — never disclosed. Justice Alito faced scrutiny over Stop the Steal and Christian nationalist flags at his properties. Neither has recused himself from politically charged cases. These aren’t accidents. They’re the predictable result of a system with no meaningful enforcement.

🔍 This Isn’t a Glitch — It’s a Strategy

What we’re watching is not isolated scandal. It is a 40-year strategy to capture the federal judiciary and use it as a policy lever immune from democratic correction.

The Federalist Society pipeline. The dark money confirmation campaigns. The same donor networks implicated in the ethics scandals funding challenges to voting rights, climate regulation, and reproductive freedom.

The Supreme Court is the only federal court with no mandatory ethics code. No term limits. No independent oversight. It polices itself — which means it doesn’t police itself at all.

What’s Happening: Supreme Court Ethics Scandals and the Conservative Supermajority’s Record

The Supreme Court didn’t arrive at its current crisis overnight. It was built — methodically, strategically, and with enormous amounts of dark money. The confirmation of three justices during the Trump administration completed a 6-3 conservative supermajority that has since dismantled decades of precedent: overturning Roe v. Wade, weakening the Voting Rights Act, and expanding presidential immunity in ways legal scholars warn are historically unprecedented.

Then came the ethics scandals. Reporting revealed that Justice Clarence Thomas accepted millions of dollars in luxury travel, real estate transactions, and private school tuition from Republican megadonor Harlan Crow — gifts never disclosed on required financial forms. Justice Samuel Alito faced scrutiny over flags flown at his properties associated with Stop the Steal and Christian nationalism. That contrast makes the dysfunction at the federal level all the more glaring.

This is what accountability failure looks like: not dramatic. Incremental. And devastating.

When the Court Is Unaccountable, Power Concentrates at the Top

Every system of unchecked power has beneficiaries. The current Supreme Court is no exception.

The fossil fuel industry has spent decades and billions funding legal challenges to environmental regulation. A Court stacked with justices skeptical of the administrative state — and reluctant to enforce the Endangerment Finding — is a $100 billion gift to oil and gas companies. Offshore drilling expansion, gutted Clean Air Act enforcement, and weakened EPA authority don’t happen by accident. They are the return on investment for a 40-year legal strategy.

Justices serve lifetime appointments with no term limits, no mandatory recusal standards with real enforcement teeth, and no independent oversight body. The Court effectively polices itself — which is to say, it doesn’t police itself at all.

🎓 Tennessee religious charter school fight could tee up next Supreme Court showdown

• The Supreme Court agreed to hear a case that could determine whether states may allow publicly funded charter schools to be operated by religious organizations.
