The Supreme Court is considering whether immigration judges have authority to review certain enforcement decisions. At issue is how much discretion judges should have when evaluating government actions, “the administration wants the justices to spurn a lower court for allowing the lawsuit to proceed before a federal district judge.” Advocates argue judicial oversight is essential for due process, while opponents say it could hinder enforcement.
